User Agreement

1. Acceptance of terms

By signing up or accessing TalkBot, you're agreeing to follow these Terms. If you're registering on behalf of an organization, you represent that you hold the necessary authority to commit that organization to these conditions. Should you disagree with any provision, please refrain from using the service.

2. Accounts

You bear full responsibility for all activities that occur under your account and must maintain the confidentiality of your login information. Contact our support team immediately if you notice any signs of unauthorized entry or suspicious activity. Users must be at least 16 years old to access TalkBot. We strongly recommend enabling two-factor authentication (2FA) to add an extra layer of security to your account.

3. Acceptable use

You commit to using TalkBot only for lawful purposes and in ways that respect the rights of others. Specifically, you agree not to:

• Engage in any illegal activity or violate applicable laws and regulations.
• Submit content that infringes intellectual property rights, contains malicious material, or is misleading in nature.
• Attempt to decode the service architecture, resell access to others, create excessive load on servers, or work around built-in restrictions.
• Create or deploy AI assistants that falsely represent themselves as a real person or legitimate entity without clear disclosure.

4. Your content

Full ownership of all material you upload and all outputs generated by your assistants remains with you. You authorize TalkBot to store, process, and transmit your content exclusively for the purpose of operating and improving the service. Review our Privacy Policy to understand our data handling practices.

5. Billing and refunds

Subscription fees are charged upfront and renew automatically each billing cycle. All payments are final and non-refundable, except as mandated by applicable law. We will notify you in advance of any fee increases, and you retain the right to cancel at any time. Your access will continue without interruption through the end of your current billing period following cancellation. If you file a chargeback or dispute a charge, we reserve the right to immediately deactivate your account and permanently revoke access to all services. Refund requests are not accepted once a subscription has commenced.

6. Chat widget when the plan has expired

Once your trial or subscription ends and you do not renew, your website visitors will see a notice that the chat widget is unavailable. The AI assistant will no longer respond to conversations, and there will be no option to contact your team through the widget.

Unavailable notice
This message appears as the greeting and in response to any visitor message while your plan is inactive: "This chat is currently unavailable. Please check back later."

Out-of-credits notice
If your account remains active but you've exhausted your monthly AI credits, visitors will see this message: "Our assistant is taking a short break. Leave your message and the team will reply to you here or by email." Conversations will be routed directly to your inbox for your team to handle manually.

To restore your chat widget and resume service, simply renew your subscription. Your chat history and settings will be preserved, allowing you to pick up exactly where you left off.

7. Service availability and modifications

TalkBot is provided in its current state, and while we're committed to maintaining uptime and performance, we don't guarantee uninterrupted availability. We may perform system maintenance, roll out feature updates, make technical adjustments, or modify the service offerings. We'll work to communicate significant changes and minimize service interruptions whenever possible.

8. Account security and user responsibility

You are responsible for safeguarding your account credentials and should never share sensitive information such as credit card numbers, payment details, or personal identifiers within chat conversations. Our team will never request such information through chat or message platforms. If verification of personal details is necessary, we'll provide secure links or direct you to authenticated channels. Two-factor authentication is available to all users and highly recommended for enhanced security. By accepting these Terms, you acknowledge that you understand the risks associated with online platforms and agree to take reasonable precautions to protect your account.

9. Limitation of liability and disclaimer

To the fullest extent allowed under law, TalkBot shall not be held accountable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the service. This includes but is not limited to damages from data breaches, unauthorized access, or misuse of the platform, regardless of whether we were made aware of the possibility of such damage. Under no circumstances shall our total cumulative liability exceed the amount you have paid to TalkBot over the 12 months preceding your claim. TalkBot disclaims any responsibility for data security incidents, system vulnerabilities, or third-party interference, and you agree to use the service at your own risk.

10. Termination and data access

You may terminate your account and discontinue using TalkBot at any moment. TalkBot reserves the right to suspend or terminate your access if we determine that these Terms have been breached. Upon account termination, you'll have a 30-day window to retrieve and export your data before permanent deletion occurs. Accounts created through fraudulent means or repeated violations of our policies may face immediate and permanent suspension without notice.

11. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction where TalkBot is headquartered, without regard to its conflict of law provisions. Any legal disputes, claims, or proceedings shall be brought exclusively in the courts of our country of residence, and you consent to the jurisdiction and venue of such courts.
